TruckAssist AI - Terms of Service

1. Acceptance of Terms

By accessing or using TruckAssist AI’s services, including AI-powered recruiting, lead generation, and related automation tools ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

TruckAssist AI provides AI-powered recruitment, lead generation, and digital marketing services for trucking companies. Our Services include AI-driven communication with driver candidates, automated screening, and digital advertising campaign management.

3. No Guarantee of Hiring Outcomes

TruckAssist AI provides tools to assist in driver recruitment and lead generation but does not guarantee the hiring, retention, or performance of any candidate sourced through our platform. The client is solely responsible for vetting, onboarding, and managing hired personnel.

4. Limitation of Liability

To the fullest extent permitted by law, TruckAssist AI, its affiliates, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, business interruptions, reputational damage, or legal liabilities arising from:

Use or inability to use our Services.Errors, omissions, or inaccuracies in the data provided.Any actions or decisions made based on information received through our platform.The conduct of any third party, including but not limited to job applicants, drivers, or external marketing platforms.

5. Service Fees & Payments

Fees for Services are charged as per the agreed-upon subscription plan or one-time service fee.Payments are due as stated in the agreement and are non-refundable unless otherwise specified.TruckAssist AI reserves the right to suspend Services for non-payment.

6. AI Functionality & Limitations

TruckAssist AI utilizes artificial intelligence for communication, lead processing, and marketing automation. AI-based responses and data analysis are generated automatically and may not always be accurate, complete, or up-to-date.Clients acknowledge that AI-generated interactions are for informational and operational purposes only and should not be relied upon as legal or human-reviewed communications.

7. No Employment or Agency Relationship

TruckAssist AI is not an employer, recruitment agency, or staffing firm. The use of our platform does not establish an employment relationship between TruckAssist AI and any driver candidate. Clients remain responsible for all hiring decisions, compliance with labor laws, and employer-related obligations.

8. Data Privacy & Compliance

TruckAssist AI collects and processes data as necessary to provide its Services. By using our Services, you consent to the collection, storage, and processing of data as outlined in our Privacy Policy.We make reasonable efforts to comply with relevant data protection laws; however, clients are responsible for their own compliance with employment, advertising, and data privacy regulations applicable to their use of the Services.

9. Indemnification

Clients agree to indemnify, defend, and hold harmless TruckAssist AI from any claims, liabilities, damages, losses, and expenses arising from:

Client’s use or misuse of the Services.Any violation of these Terms.Non-compliance with employment or marketing regulations.Any disputes between clients and third parties, including job applicants or regulatory bodies.

10. Service Modifications & Termination

TruckAssist AI reserves the right to modify, suspend, or discontinue any aspect of the Services at any time without liability.Clients may terminate their use of Services as per the agreed-upon terms in their service agreement.

11. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the jurisdiction in which TruckAssist AI operates. Any disputes arising from these Terms shall be resolved through arbitration or mediation before resorting to legal action.

12. Changes to Terms

TruckAssist AI reserves the right to update these Terms at any time. Continued use of the Services after changes have been made constitutes acceptance of the revised Terms.
